C-Quest is an independent cost consultancy and an allied practice of KEO International Consultants, providing professional cost management, quantity surveying, and project development services across the Middle East and internationally. We are registered and regulated by RICS (Royal Institution of Chartered Surveyors) for the delivery of professional cost management services.

These Terms are governed by the laws of the United Arab Emirates, including UAE Federal Law No. 15 of 2020 on Consumer Protection and UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services.

By accessing or using our Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website.

2. Definitions

"Services" refers to the professional cost consultancy services offered by C-Quest, including but not limited to: feasibility studies, risk analysis, life cycle costing, procurement advice, cost management, tender documentation, bills of quantities, contract administration, payment certifications, claims management, and value engineering.

(a) AI tools may be used as part of our service delivery process;

(b) all final deliverables and professional advice are reviewed and approved by appropriately qualified professionals;

(c) C-Quest retains responsibility for the professional services provided, regardless of whether AI tools were used in their production.

7.3 No Warranty for AI Outputs

While we take reasonable steps to ensure the accuracy of AI-assisted outputs, we do not warrant that AI tools are error-free. Any outputs from AI tools used in our services are subject to professional review before being provided to clients.

8. Use of Artificial Intelligence in Our Services

You agree to defend, indemnify, and hold harmless C-Quest and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from:

(a) your use of and access to the Website;

(b) your violation of any term of these Terms;

(c) your violation of any third-party right, including any copyright, property, or privacy right;

(d) any claim that your use of the Website caused damage to a third party; or

(e) your unauthorized use of any Content for AI training, data mining, or similar purposes.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

You agree to submit to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, for the resolution of any disputes arising out of or relating to these Terms or your use of the Website.

For users accessing our services through our offices in other jurisdictions:

(a) Saudi Arabia: Disputes may alternatively be resolved in accordance with Saudi law and the jurisdiction of Saudi courts where applicable.

(b) Qatar: Disputes may alternatively be resolved in accordance with Qatari law and the jurisdiction of Qatari courts where applicable.

(c) Portugal/EU: For consumers in the European Union, mandatory consumer protection laws of your country of residence may apply, and you may have the right to bring proceedings in your local courts.

15. Dispute Resolution

Before initiating any legal proceedings, you agree to first contact us to attempt to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, either party may proceed with formal dispute resolution.

For commercial disputes, the parties agree to consider mediation or arbitration under the rules of the Dubai International Arbitration Centre (DIAC) before resorting to litigation, unless urgent injunctive relief is required.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the original provision.

17. Waiver

The failure of C-Quest to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by C-Quest.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and C-Quest regarding your use of the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.

19. Language

These Terms are provided in English. If these Terms are translated into any other language and there is a conflict between the English version and the translated version, the English version shall prevail.

21. Additional Jurisdictional Notices

21.1 UAE Consumer Rights

If you are a consumer in the UAE, you may have additional rights under UAE Federal Law No. 15 of 2020 on Consumer Protection. Nothing in these Terms affects your statutory rights as a consumer.

21.2 Saudi Arabia

Users in Saudi Arabia are subject to applicable Saudi laws and regulations, including the Saudi E-Commerce Law and its implementing regulations.

21.3 European Union (Portugal)

If you are a consumer in the European Union accessing our services through our Portugal offices, you may have additional rights under EU consumer protection laws, including the right to withdraw from distance contracts within 14 days and protections under the EU Consumer Rights Directive.
